Chapter 1: General Provisions

 

Article 1 (Purpose)

 

The purpose of these terms and conditions is to stipulate the terms and conditions of use and procedures for all services (hereinafter referred to as “services”) provided on the FUSION.ENC (hereinafter referred to as the “company”) website.

 

Article 2 (Definition)

 

The definitions of terms used in these terms and conditions are as follows.

 

User: A person who receives the service provided by the company in accordance with these terms and conditions

Use contract: A contract concluded between the company and the user in relation to the use of the service

Member: A person who has registered as a member by providing personal information necessary for membership registration on this site

User number (ID): A combination of English letters and numbers selected by the user and approved by the company for member identification and member service use

Termination of use: The company or member expresses an intention to terminate the use contract after using the service

 

Article 3 (Effect and Change of Terms and Conditions)

If a member does not agree to the changed terms and conditions, he/she may request to withdraw from membership (cancellation). If the member continues to use the service without expressing his/her intention to refuse even after 7 days from the effective date of the changed terms, he/she is deemed to have agreed to the changes to the terms and conditions.

 

These terms and conditions become effective by posting them on the service screen or by posting them on the notice board or other means.

The company may change the contents of these terms and conditions if deemed necessary, and the changed terms and conditions are notified on the service screen. It's possible.

If the user does not agree to the changed terms and conditions, he/she may stop using the service and cancel his/her membership registration.

 

Article 4 (Applicable Provisions)

 

Matters not specified in these terms and conditions are subject to the provisions of the Telecommunications Basic Act, the Telecommunications Business Act and other related laws.

Chapter 2 Service Use Agreement

 

Article 5 (Establishment of Use Agreement)

 

The contract of use is established with the company's approval of the user's application and the user's agreement to the terms and conditions.

 

Article 6 (Application for Use)

 

Applications for use can be made by recording personal information on the subscription application form required by the company on the membership information screen of the service.

 

Article 7 (Approval of Application for Use)

 

If a member applies for use by accurately filling out all the details in the application, the application for the use of the service will be accepted unless there are special circumstances. You may not approve the use in the following cases.

When you do not apply under your real name

When applying using someone else's name

When false information in the application for use

When an application is made for the purpose of disturbing the social well-being or public morals

When other company does not meet the requirements for application for use

Article 8 (Change of Contract Matters)

Members must correct any changes to the information stated at the time of application for use, and members are responsible for any problems arising from failure to correct them.

 

Chapter 3 Obligations of Contracting Parties

 

Article 9 (Obligations of the company)

 

The company does not disclose or distribute the member's personal information known in relation to the provision of the service to a third party without the member's consent. However, this is not the case when there is a request from a national institution in accordance with the provisions of laws such as the Framework Act on Telecommunications, for the purpose of investigation into a crime, or when there is a request according to the procedures stipulated in other related laws.

 

Article 10 (Responsibilities of Members)

 

Members must not engage in any of the following acts when using the service.

Acts that illegally use another member's ID

Acts that copies, publishes, or provides information obtained from the service to a third party

Acts that infringe other rights such as the company's copyright or the copyright of a third party

Acts that distribute content that violates public order and morals

Acts that are objectively judged to be related to a crime

Acts that violate other related laws

Members cannot conduct business activities using the service, and the company is not responsible for the results of using the service.

Members cannot transfer or gift the right to use the service or other status in the contract of use to another person, and cannot provide it as collateral.

 

Chapter 4 Service Use

 

Article 11 (Responsibilities of Members)

 

Members are responsible for the maintenance of their e-mails, bulletin boards, registration materials, etc. as necessary.

Members cannot arbitrarily delete or change the data provided by the company.

Members must not register content that violates public order and morals on the company's website or that infringes other rights, such as copyrights of third parties. If such content is posted, the member is responsible for the results.

 

Article 12 (Post Management and Deletion)

 

For efficient service operation, member's memory space, message size, number of days to be kept, etc. may be limited. If the registered content falls under any of the following subparagraphs, it may be deleted without prior notice.

 

In case of content that defames other members or third parties by slander or slander

In case of content that violates public order and morals

In case of content that is recognized as being related to a criminal act

In case of content that infringes on the company's copyright, third party's copyright, etc.

In case a member posts pornography on the company's website and bulletin board or links to an obscene site

In case it is judged to be in violation of other related laws

 

Article 13 (Copyright of Posts)

 

The copyright of the post belongs to the publisher, and members cannot commercially use the materials posted on the service, such as processing or selling information obtained using the service.

 

Article 14 (Service Use Hours)

 

In principle, the use of the service is 24 hours a day, 365 days a year, unless there is a special problem in business or technology. However, this is not the case when there is a reason such as regular inspection.

 

Article 15 (Responsibility for Service Use)

 

Activities such as hacking, links to obscene sites, and illegal distribution of commercial S/W using the service are prohibited. The company is not responsible for the results and losses of business activities caused by violation of this and legal action by the relevant authorities.

 

Article 16 (Suspension of Service Provision)

 

Service provision may be stopped in any of the following cases:

 

In case of unavoidable circumstances due to construction such as maintenance of service facilities

When the key telecommunication service provider stipulated in the Telecommunications Business Act suspends the telecommunication service

When a system check is required

In case of other force majeure reasons

 

Chapter 5 Termination of Contract and Restriction of Use

 

Article 17 (Termination of Contract and Restriction of Use)

 

When a member wishes to cancel the contract of use, the member himself/herself must apply for cancellation through the Internet, and the company will take action after confirming the member's identity.

In the event that a member commits any of the following acts, the company must notify the customer 30 days prior to the cancellation action and give them an opportunity to express their opinion.

In case of stealing another person's user ID and password

In case of intentionally obstructing the operation of the service

In case of false registration application

When the same user double-registered with different IDs

In case of distributing content that is harmful to public order and morals

In the case of an act that damages the honor of others or gives a disadvantage

When a large amount of information is transmitted or advertisement information is transmitted for the purpose of interfering with the stable operation of the service

In the case of distributing computer virus programs that cause malfunction of information and communication facilities or destruction of information

In case of infringing the intellectual property rights of the company or other members or third parties

In case of illegal use of other people's personal information, user ID and password

When a member posts obscene material on his/her website or bulletin board or links to an obscene site

In case it is judged to be in violation of other relevant laws

 

Chapter 6 Miscellaneous

 

Article 18 (Prohibition of transfer)

 

Members cannot transfer or gift the right to use the service or other status in the contract of use to another person and cannot provide it as collateral.

 

Article 19 (Compensation for Damages)

 

The company shall not be liable for any damage to the member in relation to the service provided free of charge, except for damages caused by the company's intention or gross negligence.

 

Article 20 (Disclaimer)

 

If the company cannot provide the service due to a natural disaster, war, or other force majeure, the responsibility for the provision of the service is exempted.

The company is exempted from liability for damage caused by unavoidable reasons such as repair, replacement, regular inspection, and construction of service facilities.

The company is not responsible for any obstacles to service use due to reasons attributable to the member.

The company is not responsible for the profits that the member expects from using the service or for any damage caused by the data obtained through the service.

The company is not responsible for the reliability and accuracy of the information, data, facts, etc. posted by members on the service.

 

Article 21 (Competent Court)

 

If a lawsuit is filed against a dispute arising from the use of the service, the court having jurisdiction over the location of the company shall be the exclusive jurisdiction court.

(Effective Date) These terms and conditions will be effective from January 1, 2022.
